Ratio Decidendi

The court found that while the accused persons' actions—pushing the deceased during a drunken scuffle—were unlawful and directly caused the deceased's fatal injuries, there was no evidence of malice aforethought or intent to cause grievous harm. The altercation was spontaneous, not premeditated, and arose from mutual intoxication and provocation. The post mortem confirmed death from head injury consistent with a fall. Applying Section 179 of the Criminal Procedure Code, the court held that the facts proved the lesser offence of manslaughter under Section 202(1) of the Penal Code, rather than murder. The accused were accordingly convicted of manslaughter.
