Procedural Posture

Criminal Case / Ruling on Prima Facie Case

  1. 1 Whether the prosecution has established a prima facie case against the accused to warrant their being put on their defence.
  2. 2 Whether the evidence adduced links the accused to the murder of the deceased.

Ratio Decidendi

The court found that the prosecution's evidence, particularly the testimonies of witnesses who interacted with the deceased before his death and heard his dying declaration implicating the accused, as well as the circumstantial evidence of the accused being last seen with the deceased and presenting the deceased's belongings at the police station, was sufficient to establish a prima facie case. The medical evidence corroborated that the deceased died from injuries consistent with an assault. Consequently, the court ruled that the accused must be put on their defence as the prosecution had met the threshold required at this stage of the proceedings.

Court Disposition

Accused persons put on their defence.
