Legal Issues
- 1 What is the appropriate sentence for the accused, a first offender who pleaded guilty to the offence charged.
- 2 How should the period already spent in custody be considered in sentencing under Section 333 of the Criminal Procedure Code.
Ratio Decidendi
The court, after considering the accused's mitigation as a first offender, her guilty plea, and the negative pre-sentence report, determined that a custodial sentence was appropriate. However, in line with Section 333 of the Criminal Procedure Code, the period already spent in custody since February 2019 was taken into account. The court sentenced the accused to 10 years imprisonment, but after deducting the time already served, the effective sentence is 9 years imprisonment. The right of appeal within 14 days was explained to the accused.

MARY GATWIRI...ACCUSED
RULING ON SENTENCE
I have considered the mitigated on behalf of the accused. She is a first offender. She has been in custody since the time of her arrest and a mother.
I have considered the pre-sentence report which is extremely negative of the accused.
However, considering that she pleaded guilty and saved the court time. I sentence the accused to 10 years imprisonment since she has been in custody since February, 2019 under Section 333 of the code. She will serve 9 years imprisonment
14 days Right of Appeal explained.
