The court held that the dispute arising from the disciplinary action taken by the cooperative society against the applicant is not a dispute concerning the business of the cooperative society as contemplated under section 76 of the Cooperative Societies Act. The business of a cooperative society does not include the quasi-judicial determination of disciplinary claims, and when the society acts as a disciplining mechanism, it steps outside its ordinary business. Such disputes are therefore not within the exclusive jurisdiction of the Cooperative Tribunal but are subject to the constitutional supervisory jurisdiction of the High Court under Article 165(6) of the Constitution.
