The court found that the prosecution had adduced direct eyewitness evidence placing the accused at the scene and identifying him as the perpetrator of the assault on the deceased. The post mortem report corroborated the cause of death as severe head injury from a blunt object, consistent with the alleged assault. The weapon was recovered and the accused apprehended at the scene. The court held that this evidence, taken together, established a prima facie case sufficient to require the accused to be put on his defence in accordance with section 306(2) of the Criminal Procedure Code. The court therefore ruled that the accused must be placed on his defence to answer the charge of murder.
