Ratio Decidendi

The court found that the accused killed the deceased, his wife, but did so under circumstances amounting to provocation. The accused's testimony that he found his wife committing adultery and her subsequent unremorseful response was not contradicted by the prosecution. The court accepted that the accused acted in the heat of passion caused by sudden provocation, as defined under section 207 of the Penal Code. Consequently, the court held that the offence committed was manslaughter, not murder, and convicted the accused accordingly under section 202 of the Penal Code and section 322 of the Criminal Procedure Code.
