Ratio Decidendi

The court found that the applicant's constitutional complaints regarding his detention and alleged violation of rights had already been raised and determined in a previous appeal before the High Court at Embu. As such, the issues were res judicata and could not be relitigated before another High Court of equal jurisdiction. Furthermore, the Practice and Procedure Rules require that constitutional grievances be brought directly to the High Court, not by way of referral from the magistrate's court. The applicant, having already pursued and lost an appeal on the same grounds, was not entitled to leave to appeal out of time or to a stay of proceedings. The application was therefore dismissed.
