The High Court found that the subordinate court erred in ordering the release of the motor vehicle used in the commission of the offence to an unknown person without any application or inquiry into its ownership. The court held that, according to section 389A of the Criminal Procedure Code, the proper procedure required the court to inquire into the ownership of the property and give notice to the owner or interested parties before making any order for forfeiture or release.
