Procedural Posture

Judicial Review / Ruling on Reference From Taxation

  1. 1 Whether the reference challenging the taxing officer's decision was filed within the prescribed time period under the Advocates Remuneration Order.
  2. 2 Whether an objection to the taxing officer's decision is a mandatory prerequisite to filing a reference where reasons are already contained in the ruling.
  3. 3 Whether the court should entertain a reference filed out of time without leave for extension.

Ratio Decidendi

The court held that since the taxing officer's ruling contained the reasons for taxation, the applicant was not required to file a separate objection before filing a reference. However, the reference was filed outside the 14-day period prescribed by Paragraph 11(2) of the Advocates Remuneration Order, and the applicant did not seek or obtain an extension of time as required by Paragraph 11(4). Consequently, the reference was incompetent and an abuse of the court process. The court struck out the reference with costs, declining to consider the merits of the application.
