The Minister did not follow the law in the appointment process, particularly by not gazetting all required office holders and by selectively applying the Act. Although the Minister communicated the reasons for not gazetting certain nominees, the applicants were not afforded an opportunity to defend themselves against allegations of financial impropriety, violating the rules of natural justice.
