Ratio Decidendi

The court found that the applicant's application for substitution could not stand because the original society, Chorlim Marketing Co-operative Society Limited, had its name lawfully changed to Chorlim Multipurpose Co-operative Society Limited. The change of name was sanctioned by the Registrar of Co-operatives, and a certificate of change of name was exhibited and not contested by the applicant.
