The court found that while the Commissioner for Co-operatives has statutory authority to inquire into the affairs of co-operative societies and make recommendations, neither the Commissioner nor the Ministry of Industry, Trade and Co-operatives has the legal mandate to compel the transfer of registered land ownership from one entity to another. Such authority is vested exclusively in the Environment and Land Court under Article 162(2) of the Constitution. The impugned decision, which directed the applicant to hand over its property to the interested party, was therefore ultra vires and tainted with illegality.
