The local administration and the pre-bail report indicated that there was little or no guarantee that the accused would attend his trial, and the likelihood of absconding was high. The court held that the risk of flight constituted a compelling reason under Article 49(1)(h) of the Constitution to deny bail. There was no evidence that circumstances had changed since the previous denial of bail. Therefore, the application for bail was declined and the accused was ordered to remain in custody until the case was finalized.
