The court found that the Mosocho Land Disputes Tribunal acted outside its statutory jurisdiction by purporting to determine a dispute concerning ownership and title to registered land, which is expressly excluded from its mandate under Section 3(1) of the Land Disputes Tribunals Act. The tribunal's decision was therefore ultra vires and a nullity. Consequently, the Chief Magistrate's Court could not lawfully adopt such a decision as a judgment of the court under Section 7 of the Act.
