Legal Issues
- 1 Whether the gravity of the offence and circumstances justify a custodial sentence.
- 2 Whether the period served in custody prior to bond should be discounted from the sentence.

The court found that the offence committed by the accused was of a very grave nature, and the circumstances and extent of injuries did not justify the accused's conduct. The court determined that a custodial sentence was necessary to serve both retributive and deterrent purposes. Sentence
1. Having listened to address by both counsel on mitigation and after perusal of the pre-sentence report, the court views the offence as very grave. The circumstances surrounding the incident and the extent of injuries do not justify the conduct of the accused. He thus deserves a custodial sentence to serve both retribution and deterrence.
2. He is sentenced to serve a period of twelve (12) years imprisonment computed from today (October 31, 2023). That period takes into account and discounts the period served in custody before he was admitted to bond.
