The court found that, based on the evidence adduced by the prosecution, including testimony from 10 witnesses and 7 exhibits, all the essential ingredients of the offence of murder as outlined in Anthony Ndegwa Ngari v Republic [2014] eKLR were sufficiently established at this stage. Applying the legal standard for a prima facie case as articulated in Ramanlal Trambaklal Bhatt v R [1957] E.A 332 and Ronald Nyaga Kiura v Republic [2018] eKLR, the court determined that the prosecution's evidence, if unchallenged, could sustain a conviction. Therefore, the accused is required to be placed on her defence in accordance with Section 211 of the Criminal Procedure Code.
