Procedural Posture

Miscellaneous Application / Judgment

  1. 1 Whether the Municipal Council of Mombasa acted in excess or without jurisdiction in approving the change of user for Plot No. 3157/I/MN Nyali, Mombasa.
  2. 2 Whether the council breached the rules of natural justice by failing to consult adjoining landowners before approving the application for change of user.

Ratio Decidendi

The court found that the Municipal Council of Mombasa acted within its statutory jurisdiction as an interim planning authority in considering and recommending approval for the change of user application. The council was not shown to have exceeded its powers under the relevant statutes. The court further held that the applicants' right to be heard would arise at the stage when the proposal for change of user is published in the Kenya Gazette and objections are invited, not at the committee recommendation stage. Therefore, the council did not breach the rules of natural justice. The applicants' motion was thus dismissed as premature and lacking in merit.
