The court found that the applicants had obtained judgment and a decree against the Municipal Council of Nakuru, a public authority, for payment of various sums. Despite service of the decree and a demand for payment, the respondent failed to pay. The court held that mandamus is the appropriate remedy to compel a public authority to perform its statutory duty to satisfy a judgment, especially where execution against its property is barred by law.
