Ratio Decidendi

The court held that the accused failed to demonstrate any change in circumstances since the initial denial of bail. The fact that four witnesses have testified without incident and that the accused has been in custody for one year do not, in themselves, amount to a change of circumstances. The court also found that conflicting statements regarding the whereabouts of the remaining witness, Beatrice Adhiambo, were not supported by affidavit evidence and could not be relied upon. Consequently, the burden of proof required to justify a review of the bail order was not discharged, and the application was dismissed.
