Procedural Posture

Criminal Trial / Ruling on Case to Answer at Close of Prosecution Case

  1. 1 Whether the prosecution has established a prima facie case to require the accused to be put on his defence.
  2. 2 Whether the absence of a postmortem report precludes proof of the offence of murder.

Ratio Decidendi

The court found that, although the postmortem report was not produced, the evidence of eyewitnesses who saw the accused attack the deceased with a stick, and the subsequent death of the deceased from injuries sustained, constituted sufficient circumstantial evidence to establish a prima facie case of murder. The absence of medical evidence does not preclude proof of death or causation where the injuries and circumstances are clear. Therefore, the accused has a case to answer and is put on his defence.
