In this case, although the substantive dispute was settled by consent, the applicant had incurred costs due to the respondents' actions which necessitated the suit. The court found that the applicant made out a case for costs, but assessment of the quantum of costs is within the Deputy Registrar's jurisdiction. The court thus granted the applicant an order for costs, allowing him to file a bill of costs for taxation.
