Legal Issues
- 1 What is the appropriate sentence for the accused convicted of manslaughter under the circumstances of the case.
- 2 Whether the period already served in custody and the accused's family situation should mitigate the sentence.
Ratio Decidendi
The court found that the accused had already served a significant period in custody (since 14/2/2008) and that the social inquiry report was positive, indicating rehabilitation and the need for the accused to care for his young children, who were left without parental care after the death of their mother. The court determined that further incarceration would not serve the interests of justice or the welfare of the children. Accordingly, the court exercised its discretion under Section 35(1) of the Penal Code to discharge the accused unconditionally, finding that the period already served was sufficient punishment given the circumstances.
Court Disposition
accused discharged unconditionally under Section 35(1) of the Penal Code
Orders

SENTENCE
After convicting the accused on a reduced charge of manslaughter this Court called for a detailed social inquiry report before sentence. The report has given a true picture of what transpired. It has also confirmed that the accused lost his wife while he was in Prison. It has also confirmed that the accused's children who are still young are staying with relatives which is not very healthy for them.
Considering the circumstances that led to the commission of the offence and the fact that the accused has been in Prison custody since 14/2/2008, I do find that a period of 5 years incarceration has taught him a lesson. The children need him more than anything else.
The social inquiry report on the accused is very positive. I therefore discharge him under Section 35(1) of the Penal Code unconditionally.
