The court found that the prosecution had adduced sufficient evidence through its six witnesses to establish a prima facie case against the accused, Mwabili Kirigha, for the offence of murder. The evidence presented, if believed, could support a conviction. Therefore, the accused was placed on his defence in accordance with the requirements of Section 306(2) of the Criminal Procedure Code.
