The prosecution failed to establish a prima facie case against the accused. There was no evidence connecting the accused to the deaths of Elijah Thuku or Samuel Thande, nor was there evidence as to the cause of death or the circumstances under which the deaths occurred. The prosecution did not prove any of the essential ingredients of murder, including malice aforethought, as required by law. Consequently, the accused could not be called upon to answer the charge, and an acquittal was warranted under Section 306(1) of the Criminal Procedure Code.
