The certificate annexed to the application showed a different amount (Kshs 389,222.12) than the amount claimed (Kshs 116,192/=), and the dates of the certificates referenced in the pleadings were inconsistent. Due to these discrepancies, the court held that the amount payable was not certain and the certificate of costs annexed was not capable of enforcement. As a result, the application for mandamus was not competently before the court and could not be granted.
