Ratio Decidendi

The court held that since the matter was settled by consent of the parties and the terms of the settlement were not disclosed, there was no material before the court to determine which party was successful. The general rule that costs follow the event could not be applied in the absence of a determination on the merits or knowledge of the settlement terms. The court further held that declaratory reliefs are not available in judicial review proceedings, which are limited to the remedies of mandamus, certiorari, and prohibition. In the circumstances, the court exercised its discretion to order that each party bear its own costs, as there was no basis to award costs to either side.
