The court held that the procedural defect of the verifying affidavit not being under company seal was not fatal and could be remedied by a supplementary affidavit, in line with Article 159 of the Constitution and the overriding objective principle. On jurisdiction, the court found that although the Environment and Land Court had been established, it was not yet operational, so the High Court retained jurisdiction over environment and land matters. The National Environment Tribunal remained in existence by virtue of the transitional provisions of the Constitution, and the statutory appeal procedure under EMCA was still available.
