The court found that the National Land Commission acted beyond its jurisdiction by purporting to revoke the applicants. title to LR No. 17439 after the Environment and Land Court had already determined ownership in Mombasa ELC No. 79 of 2012. The Respondent failed to demonstrate that proper notice was served on the applicants or that they were afforded a fair hearing. Once the court had adjudicated the ownership dispute and issued a permanent injunction against the Interested Parties, the Commission could not lawfully reopen or revisit the matter.
