Procedural Posture

Judicial Review / Ruling on Preliminary Objection and Application for Extension of Time

  1. 1 Whether the court has jurisdiction to enlarge time for filing the substantive Notice of Motion under Order 53 Rule 3 of the Civil Procedure Rules.
  2. 2 Whether the delay in filing the Notice of Motion was inordinate and prejudicial to the Respondents.
  3. 3 Whether the Notice of Motion filed out of time can be admitted by the court.

Ratio Decidendi

The court held that Order 53 Rule 3 of the Civil Procedure Rules is mandatory and requires that a substantive motion in judicial review be filed within 21 days of leave being granted. The court lacks jurisdiction to enlarge this period, and neither Article 159(2) of the Constitution nor Order 50 Rule 6 can be invoked to extend time in judicial review proceedings. As such, the Notice of Motion filed out of time was incompetent and incapable of being adjudicated upon. The application for extension of time was dismissed, and the Notice of Motion was struck out. Each party was ordered to bear its own costs.

Court Disposition

Notice of Motion struck out for being filed out of time; each party to bear its own costs.

Orders

  • The Notice of Motion dated 24th November, 2017 is struck out.
