Ratio Decidendi

The court found that the Ndivisi Land Disputes Tribunal acted in excess of its jurisdiction by entertaining and determining a dispute concerning registered land, contrary to the express provisions of the Land Disputes Tribunal Act and the Registered Land Act. The tribunal's award, as adopted by the Senior Resident Magistrate's Court, was therefore a nullity. The High Court allowed the application for certiorari, quashed the tribunal's decision and the subsequent adoption as a judgment of the magistrate's court, and ordered that each party bear their own costs.
