RULING.
All the three accused persons are charged with the offence of Murder Contrary to Section 203 as read with Section 204 of the Penal code. The prosecution closed its case after calling eight (8) witnesses. None of these witnesses said anything touching on Harun Kipchirchir Langa alias Weldon (Accused 3).
I therefore acquit him under Section 306(2) of the Criminal Procedure Code.
On the other hand I find a prima facie case made out against Accused 1 and Accused 2 who I hereby place on their defence under Section 306(2) of the Criminal Procedure code.
