The court held that, had the subordinate court been aware of the commencement of the criminal trial, it would likely not have ordered the release of the vehicle. The High Court determined that the release of the vehicle at this stage could prejudice the ongoing criminal proceedings and undermine the prosecution's case. Therefore, the order for release was set aside, and any future application for release of the vehicle must be made in the context of the pending criminal case.
