The evidence presented consisted solely of hearsay and circumstantial accounts from two witnesses, neither of whom witnessed the alleged murder or provided direct evidence linking the accused to the deceased's death. The accused's brother, who was said to have relevant information, was not called to testify, and the post mortem report was not produced to confirm the cause of death. The court held that the prosecution's evidence was insufficient to require the accused to be placed on his defence. Accordingly, the accused was acquitted under Section 210 of the Criminal Procedure Code.
