1. Meshack Nyansikera Ombati hereinafter referred to as the accused is charged with the offence of murder contrary to section 203 as read with section 204 of the Penal Code. The accused denied the charge and the case proceeded to full hearing with the prosecution calling a total of eight (8) witnesses.
2. The post mortem report (EXB 2) showed the cause of death to be due to massive blood loss. He had slash wounds on left elbow and neck and others. His death was not a natural death. PW1, PW4 and PW6 testified on what they witnessed and knew about the murder.
3. I have evaluated all this evidence plus the submissions by the prosecution, and I am satisfied that the prosecution has established a prima facie case against the accused. I therefore place him on his defence under section 306(2) of the Criminal Procedure Code.
4. Orders accordingly.
