The High Court found that the Principal Magistrate who reviewed and reduced the bond terms set by a Senior Principal Magistrate acted without jurisdiction. The matter had only been set for mention before the Principal Magistrate, not for hearing or substantive orders. The law and judicial practice require that a magistrate of lower rank should not review or reverse substantive orders made by a more senior magistrate, especially in serious offences such as trafficking in narcotics with high penalties.
