Ratio Decidendi

The appellate court found that the prosecution had proved the offence of theft against the respondent to the required standard. The respondent borrowed the complainant's phone and subsequently gave it to another person without the owner's consent, amounting to conversion and demonstrating intent to permanently deprive the complainant of his property. The evidence of the complainant was corroborated by his father, and the trial magistrate erred in failing to appreciate the sufficiency and weight of this evidence. The acquittal was therefore quashed, and the respondent was convicted of stealing under section 275 of the Penal Code.
