The court found that the only evidence linking the accused to the murder was hearsay from Katungwa and/or Anne Katunge, who was not called as a witness. No direct or circumstantial evidence was adduced placing the accused at the scene of the crime or establishing malice aforethought. The prosecution failed to establish a prima facie case against the accused persons. Consequently, the court entered a verdict of not guilty under section 306(1) of the Criminal Procedure Code and acquitted both accused persons.
