Legal Issues
- 1 Whether the accused should be sentenced to imprisonment or probation for the offence of manslaughter.
- 2 What weight should be given to the period already spent in custody and the probation report.
Ratio Decidendi
The court found that, despite the gravity of the offence and the breach of trust by the accused, the positive probation report and the period already spent in custody justified a blended sentence. The accused was sentenced to serve one year in prison followed by three years on probation, balancing retribution, deterrence, and the prospects of rehabilitation. The court emphasized the importance of considering both the interests of justice and the circumstances of the offender, especially in cases resolved through plea bargaining.
Court Disposition
accused sentenced to one year imprisonment and three years probation
Orders
- The accused shall serve one year imprisonment.
- The accused shall serve three years on probation after the custodial sentence.
