Legal Issues
- 1 Whether the accused persons should be sentenced for manslaughter after plea bargaining and conviction on admission.
- 2 What is the appropriate sentence for the accused persons given the circumstances of the offence and their time in custody.
Ratio Decidendi
The court found that the accused, having pleaded guilty to manslaughter after plea bargaining, were entitled to a sentence reflecting both the seriousness of the offence and the mitigating circumstances, including their familial relationship with the deceased, the remorse shown, and the positive social inquiry report. The period already spent in custody was also taken into account. The court determined that a custodial sentence of one year, followed by three years on probation, was appropriate to balance punishment, rehabilitation, and reintegration into the community.
Court Disposition
Both accused persons sentenced to four years each: one year imprisonment and three years probation.
Orders
- Each accused to serve one year imprisonment.
- Each accused to serve three years on probation after imprisonment.

Both accused were charged with murder contrary to Section 203as read with Section 204 of the Penal Code. The charge was reduced to Manslaughter after plea bargaining. They were then convicted on admission.
The accused persons and the deceased were brothers. I find the serious attack on the deceased by both accused persons to have been uncalled for.
The social inquiry report shows that the home environment is receptive to their return.
The accused persons have been in custody for one (1) year eight (8) months.
I sentence each to four (4) years to be served as follows:
(i) The first one (1) year will be served in prison (one year imprisonment).
