Procedural Posture

Judicial Review / Judgment

  1. 1 Whether the applicant is entitled to an order of mandamus to compel the respondent to pay interest on the decretal amount and costs awarded in HCC 1963 of 1993.
  2. 2 Whether Section 26(2) of the Civil Procedure Act applies where the decree is silent on interest.

Ratio Decidendi

The court found that since the decree in HCC 1963 of 1993 was silent on the issue of interest and the High Court did not exercise its discretion to award interest under Section 26(1) of the Civil Procedure Act, Section 26(2) was inapplicable. The applicant was not entitled to interest on the principal sum or costs, regardless of the delay in payment. Furthermore, the applicant had not sought interest as a relief in her pleadings, and the court could not grant orders not prayed for. The application for mandamus to compel payment of interest was therefore dismissed as having been overtaken by events, with the respondent having already paid the principal and costs.

Court Disposition

Application dismissed; costs awarded to applicant.

Orders

  • The application for orders of mandamus is dismissed as overtaken by events.
  • The applicant is awarded costs of the application to be borne by the respondent.
