  1. 1 Whether the 1st respondent was served with and aware of the court order issued on 8th July, 2015.
  2. 2 Whether the 1st respondent willfully disobeyed the court order for payment of decretal sum to the ex-parte applicants.
  3. 3 Whether the court should commit the 1st respondent to civil jail for contempt of court.

Ratio Decidendi

The court found that the 1st respondent was duly served with and aware of the court order issued on 8th July, 2015, which directed payment of Kshs. 1,300,000 plus costs and interest to the ex-parte applicants. Despite proper service and notification, the 1st respondent failed and/or neglected to comply with the order. The court emphasized that court orders are not issued in vain and must be obeyed by all parties. The deliberate disobedience by the 1st respondent amounted to contempt of court. Consequently, the court exercised its jurisdiction to commit the 1st respondent to civil jail for a period of six months for contempt of court, and awarded costs to the applicants.

Court Disposition

Application allowed. 1st respondent committed to civil jail for six months for contempt of court. Costs awarded to applicant.
