The court found that the prosecution failed to adduce any evidence directly linking the accused to the death of the deceased. The only basis for the accused's arrest was suspicion, which, as established in Sawe v The Republic (2003) eKLR, is insufficient to sustain a conviction. The postmortem confirmed the cause of death as asphyxiation due to manual strangulation, but there was no evidence implicating the accused. Consequently, the court held that the prosecution had not established a prima facie case against the accused and acquitted him under Section 306(1) of the Criminal Procedure Code.
