The evidence of identification was unreliable due to poor lighting conditions and the fact that PW2 did not know the assailant prior to the incident. PW4's evidence was inconsistent and did not corroborate PW2's account. There was no credible dying declaration as the deceased was already dead when PW4 arrived at the scene. The prosecution did not call the investigating officer or adduce medical evidence to prove the cause of death.
