Legal Issues
- 1 Whether the accused was criminally liable for the death of his wife under the circumstances of provocation.
- 2 What sentence was appropriate given the facts, probation report, and mitigation.
Ratio Decidendi
The court found that the accused was provoked by the deceased, who first attacked him with a metal bar and then attempted to use a machete. Although the accused had disarmed the deceased, he used excessive force by striking her on the head with the metal bar, resulting in her death. The court considered the probation report, the period already spent in custody, and the mitigating circumstances, including the provocation and the relationship between the parties. Balancing these factors, the court determined that a custodial sentence was warranted but exercised leniency by sentencing the accused to one year imprisonment.
Court Disposition
accused sentenced to one year imprisonment
Orders
- The accused is sentenced to serve one (1) year imprisonment.
- The accused may appeal within 14 days.

PETER MUTHOKA MULA …………..………….……………....… ACCUSED
S E N T E N C E
I have considered the facts, the probation report and mitigation. The deceased was the wife of the accused. She appears to have provoked the incident which resulted in her death. She hit the accused with a metal bar. Then she advanced for a machete in an attempt to cut the accused. The accused used the metal bar to hit the deceased on the head. The probation report recommends a probation sentence. The accused has been in custody for more than one year.
In my view, considering the circumstances of the case, the accused deserves leniency. However, he used a lot of force and hit the deceased on the head after disarming her. I sentence the accused to serve one (1) year imprisonment. He may appeal within 14 days.
