The only evidence linking the accused to the crime was hearsay, as the key witness, Semeyo Omsee, was deceased and his evidence did not directly implicate the accused. The court held that suspicion, however strong, is insufficient to establish guilt in a criminal case, and there was no other evidence connecting the accused to the death of the deceased. Consequently, the prosecution failed to establish a prima facie case, and the accused was acquitted under section 306(1) of the Criminal Procedure Code.
