Procedural Posture

Criminal Case / Ruling on No Case to Answer After Close of Prosecution Case

  1. 1 Whether the prosecution established a prima facie case against the accused to warrant placing him on his defence.
  2. 2 Whether the evidence adduced sufficiently identified the accused as the perpetrator of the offence.
  3. 3 Whether the prosecution proved the charge of murder beyond reasonable doubt.

Ratio Decidendi

The court found that the prosecution failed to establish a prima facie case against the accused. The evidence on the identity of the person who assaulted the deceased was weak and inconclusive. No witness saw the accused commit the offence, and the identification evidence was unreliable. The police investigation was found to be unprofessional, leaving many loose ends and failing to link the accused to the crime beyond reasonable doubt. Consequently, the court held that there was no evidence upon which it could place the accused on his defence, and therefore, in compliance with Section 306(1) of the Criminal Procedure Code, the accused was acquitted for no case to answer.
