Procedural Posture

Criminal Case / Ruling on Prima Facie Case at Close of Prosecution's Case

  1. 1 Whether the prosecution has established a prima facie case against the accused to warrant him being put on his defence.
  2. 2 Whether the evidence presented by the prosecution is sufficient to require the accused to answer to the charge of murder.

Ratio Decidendi

The court found that the prosecution, through the testimony of five witnesses, established a prima facie case against the accused, Phineas Murithi Muuga, for the offence of murder as defined under Section 203 as read with Section 204 of the Penal Code. The evidence presented was sufficient to require the accused to be put on his defence, as a reasonable tribunal could convict on the basis of the prosecution's case if no explanation is offered by the accused. The court therefore ruled that the accused must be called upon to defend himself against the charge of murder.

Court Disposition

Accused to be put on his defence.

Orders
