Ratio Decidendi

The court found that the Political Parties Disputes Tribunal does not have jurisdiction to punish for contempt of its own orders because such jurisdiction has not been expressly conferred by the relevant Act of Parliament. Jurisdiction must be derived from the Constitution or statute, and in the absence of such provision, the Tribunal cannot entertain contempt proceedings. The only avenue for enforcement of contempt in such circumstances is the High Court. Consequently, the application for judicial review orders of mandamus and certiorari compelling the Tribunal to enforce or determine the contempt application was without merit and was dismissed.
