Miscellaneous Application / Ruling on Costs After Withdrawal of Main Application

  1. 1 Whether the applicants are entitled to costs after withdrawal of judicial review proceedings.
  2. 2 Whether the conduct of the respondents justified depriving them of costs.
  3. 3 Whether public interest litigation affects the award of costs.

Ratio Decidendi

The court held that since the proceedings were withdrawn by the applicants before determination, the normal rule would be to award costs to the respondents. However, the court found no evidence that the respondents violated the stay order, and the subject matter was public interest litigation. In such cases, courts are reluctant to penalize parties with costs to avoid discouraging public interest actions. The court exercised its discretion under section 27 of the Civil Procedure Act, considering the conduct of the parties and the nature of the litigation, and determined that each party should bear its own costs.

Court Disposition

Each party to bear its own costs; no order as to costs.

Orders

  • There be no order as to costs. Each party will bear their own costs.
