Ratio Decidendi

The court found that while the ex parte Applicant had obtained judgment and made requests for payment, she failed to provide evidence of a Certificate of Order against Government or its service on the Attorney General as required by Section 21 of the Government Proceedings Act. Compliance with this statutory procedure is a condition precedent to seeking an order of mandamus to compel payment by the government. Without proof of these steps, the application for mandamus was premature and could not be granted. The Notice of Motion was therefore struck out, but the Applicant was granted liberty to file fresh proceedings upon compliance with the Act.
